1. THE CONTRACT
1.1 The Agreement: These Booking Conditions, together with your finalised itinerary and invoice, form a legally binding contract between you (the “Client” or “Traveler”) and Tales of the Tropics LLC, a company registered in the State of Wyoming, USA (“Company,” “we,” or “us”).
1.2 Acceptance: By paying your booking deposit, you confirm that you have read, understood, and accepted these Terms and Conditions on behalf of all persons named in the booking.
2. BOOKING & PAYMENT
2.1 Deposit: To secure your exclusive accommodation and drivers, a deposit of 30% of the total trip price is required.
2.2 The Balance: The remaining 70% of the total trip price must be paid no later than 60 days prior to your arrival date.
2.3 Payment Methods: To minimise international processing fees and ensure security for high-value transactions, we only accept bank transfers in EUR, USD, or GBP.
2.4 Late Payment: If the balance is not received by the due date, we reserve the right to treat your booking as canceled, and the cancellation charges in Section 3 will apply.
3. CANCELLATION & REFUNDS (BOUTIQUE FAIRNESS POLICY)
We believe in a fairer approach to travel. If you must cancel your trip, the following charges apply:
3.1 Cancellation more than 60 days before arrival: We will refund 50% of your deposit. The remaining 50% is retained to cover bespoke planning, administration, and hotel holding fees.
3.2 Cancellation between 60 and 45 days before arrival: 50% of the total trip price is retained.
3.3 Cancellation less than 45 days before arrival: 100% of the total trip price is retained, as all local suppliers and hotels have been paid in full and funds are no longer recoverable.
3.4 Force Majeure: If we are forced to cancel your trip due to unforeseeable circumstances (war, natural disaster, pandemic), we will return all recoverable costs provided by our suppliers.
4. BEHAVIOUR & CONDUCT
4.1 Standards of Conduct: We expect all guests to behave in a respectful manner toward our staff, guides, drivers, and local communities.
4.2 Termination for Cause: If, in the considered opinion of the Company or our fulfillment partners, your behavior is deemed dangerous, distressed, or chronically abusive (including but not limited to racism, verbal abuse, or illegal acts), we reserve the right to terminate your trip immediately.
4.3 No Compensation: In the event of a behavior-based termination, the Company will have no further responsibility to the traveler, and no refunds or compensation for lost travel arrangements will be provided.
5. COMPLAINTS & PROBLEM SOLVING
5.1 Immediate Reporting: If you encounter any issue during your trip (e.g., room quality, transport issues, or service standards), you must report it to us within 24 hours via our provided local WhatsApp support line.
5.2 Resolution: This allows us the opportunity to rectify the situation immediately with the local supplier.
5.3 Retrospective Claims: The Company will not be held liable for complaints or compensation claims raised after the trip has concluded if the issue was not reported to us at the time of occurrence.
6. MANDATORY TRAVEL INSURANCE
6.1 Requirement: It is a strict condition of booking that every member of your party holds comprehensive travel insurance.
6.2 Coverage: Your policy must cover, at a minimum: trip cancellation, medical emergencies, emergency repatriation, and personal liability.
6.3 Responsibility: Tales of the Tropics LLC is not liable for any financial loss or medical expense incurred due to your failure to secure adequate insurance.
7. SAFETY & TRANSPORT STANDARDS
7.1 Vehicle Vetting: We use reasonable endeavors to vet our partners to ensure vehicles are modern, air-conditioned, and equipped with functioning seatbelts.
7.2 Independent Fleet: As we do not own the vehicles directly, we cannot provide an absolute guarantee of specific equipment functionality at all times.
7.3 Guides: All guides provided are licensed by the Sri Lanka Tourism Development Authority (SLTDA).
8. LIMITATION OF LIABILITY
8.1 Independent Suppliers: Tales of the Tropics LLC acts as a designer and facilitator. We do not own or manage the hotels, vehicles, or activity centers. We are not liable for any injury, loss, damage, or delay occasioned by the error or negligence of these independent third-party suppliers.
8.2 Maximum Liability: Our total liability for any claim shall be limited to the total amount paid by you to us for the specific booking.
9. GOVERNING LAW & JURISDICTION
9.1 Wyoming Law: This contract and any dispute arising from it shall be governed exclusively by the laws of the State of Wyoming, USA.
9.2 Legal Action: Any legal proceedings against the Company must be filed exclusively in the courts of the State of Wyoming.
